The West Collection, to promote emerging artists, has created the West “Prize.”  This is not a “contest,” but rather an opportunity for artists from around the world to present their work for possible acquisition by the West Collection.  Artists are invited to submit their artwork (any artistic, multi-media or video work) for consideration.  The only limitations are that the artist must be over 18, the artwork was created within the last 3 years, and it has to be available for acquisition when submitted.  Fully completed entries have to be submitted to the West Collection by midnight, October 1, 2008, Eastern Time to be considered. 


If the judge(s) decide that there are at least ten eligible entries, then the West Collection will select ten works and negotiate the purchase of those works based on the price established by the artist at the time of submission.  In the event that the purchase price is less than $10,000, then the West Collection may also negotiate for the purchase of additional artwork from the artist (or the artist’s representative) so that the total amount the artist will receive is $10,000, whether or not the West Collection acquires additional works.  A single artist will be chosen from the 10 artists previously selected to have their artwork acquired and that individual will receive an additional amount of $25,000.  If we get fewer than 10 eligible entries, then the total possible amount disbursed will equal the sum of $10,000 for each eligible entrant and an additional $25,000 for the ultimate “winner.”  (Based on the large number of entries received as of July 31, 2008, these limitations that our lawyers insisted we include here will probably turn out to be totally irrelevant.)


All artists who submit their work give the West Collection permission to use their name and the images of and information about their artwork submission(s) in the West Collection's public on-line database [until December 31, 2008]. If he or she is one of the chosen ten artists, he or she also gives the West Collection and any of its agents, licensees, successors, and assignees permission to use his or her name and likeness, and the images of and information about his or her artwork submission(s) for advertising and promotional purposes, as well as for inclusion in the West Collection's public database, anywhere in the world, in all media, whether now known or later developed.


In addition, because the West Collection intends to display all the selected artists’ actual works [as part of the West Collection] from February 1, 2009 through March 1, 2009, and to include images of them in a catalog of the exhibit.  Therefore, by submitting his or her entry, each artist, if ultimately selected, agrees to grant the West Collection (and related affiliates) a nonexclusive, royalty-free, perpetual worldwide license to use his or her name, likeness (e.g., picture), submission or any combination of those, for advertising and promotional purposes, as well as to include in our public database, for display and distribution anywhere in the world in all media, whether now known or later developed. 


Finally, each artist is responsible for all federal, state and local taxes associated with his or her artwork’s acquisition by the West Collection and, if applicable, the additional $25,000 amount.
